General Terms and Conditions of Sale

Version applicable from 21 July 2026. JOHYA reserves the right to amend these T&Cs at any time. The version applicable to any order is the one in force on the date the order is placed.

Article 1 — Purpose and scope

These General Terms and Conditions of Sale (hereinafter "T&Cs") govern all contractual relations between the company JOHYA, as seller, and any natural or legal person, consumer or professional, making a purchase on the johya.com website (hereinafter "the Client").

Any order placed on the johya.com website implies the Client's full and unreserved acceptance of these T&Cs, which the Client acknowledges having read beforehand.

Article 2 — Identification of the seller

Article 3 — Products

The products offered for sale are precious stones, mainly Colombian emeralds, sold individually or in lots, mounted or unmounted.

Each product is the subject of a descriptive page specifying:

  • The weight in carats (1 carat = 0.200 gram)
  • The approximate dimensions
  • The color and saturation
  • The clarity level
  • The geographical origin (where it can be attested)
  • The type and intensity of any treatments (see Article 4)
  • The existence of a gemological certificate, where applicable

Photographs of the stones are taken under the technical conditions allowing the best possible rendition, but may show slight variations in color or appearance compared with the actual product owing to the settings of the Client's screen. Such variations cannot give rise to any liability on the part of JOHYA.

Article 4 — Treatment disclosure

In accordance with Decree No. 2002-65 of 14 January 2002 on trade in gemstones and pearls, and with the rules laid down by CIBJO (Confédération Internationale de la Bijouterie, Joaillerie, Orfèvrerie), JOHYA undertakes to disclose transparently all the treatments applied to the stones offered for sale.

For emeralds, the level of oil or resin treatment is indicated according to the international nomenclature:

  • None (no oil)
  • Insignificant
  • Minor oil (F1)
  • Moderate oil (F2)
  • Significant (F3)

This information appears systematically on the product page and, where applicable, on the gemological certificate accompanying the stone.

Article 5 — Prices

Prices are stated in euros (EUR), inclusive of all taxes for deliveries to mainland France and to the European Union, excluding delivery costs.

For deliveries outside the European Union, prices are exclusive of French VAT. Any customs duties, local taxes and customs clearance fees payable on arrival remain the sole responsibility of the recipient Client.

JOHYA reserves the right to modify its prices at any time, it being understood that the price applicable to an order is the one displayed at the time the order is validated.

Article 6 — Orders

The Client places an order by following the online purchase process on the johya.com website. The order is definitively validated after:

  • Selection of the products in the basket
  • Entry of the delivery and billing information
  • Express acceptance of these T&Cs
  • Effective payment of the order

An order confirmation email is sent to the Client at the address given when the order was placed. This email summarises the products ordered, the total amount and the delivery conditions.

JOHYA reserves the right to refuse or cancel any order in the event of:

  • A pre-existing dispute with the Client
  • Suspicion of fraud or failure to pay
  • Unavailability of the product
  • Manifest pricing error
  • Impossibility of complying with the LCB-FT obligations (see Article 13)

Article 7 — Payment

Payment is made online, at the time of the order, by the means offered on the site (bank card, and any other means of payment listed on the payment page).

Transactions are secured by Shopify's payment provider. At no time does JOHYA store the Client's complete bank details.

For orders of a high amount, JOHYA may request additional supporting documents as to identity and the origin of funds under its LCB-FT obligations (see Article 13). The order will be dispatched only after receipt and verification of these items.

Article 8 — Delivery

The delivery arrangements (areas served, lead times, carriers, charges) are set out in detail in the Delivery Policy available on the site.

Precious stones are shipped by insured shipment with mandatory signature on delivery. The Client undertakes to be available at the contact details given and to sign the delivery note.

Should the Client be absent at the first delivery attempt, the Client must follow the carrier's instructions to arrange a new attempt or to collect the parcel. Any return to sender for failure to collect within the legal time limits will give rise to new re-dispatch costs borne by the Client.

Article 9 — Receipt and inspection

The Client is invited to check the condition of the parcel and the conformity of the products on receipt, in the presence of the carrier if possible. Any anomaly (damaged parcel, missing product, apparent non-conformity) must be:

  • Noted on the carrier's delivery note
  • Reported to JOHYA by email to administratif@johya.com within 48 hours of receipt, supported by photographs

Article 10 — Right of withdrawal

In accordance with Articles L221-18 et seq. of the French Consumer Code, the consumer Client has a period of fourteen (14) calendar days from receipt of the product in which to exercise their right of withdrawal, without having to give any reason for their decision.

To exercise this right, the Client must notify JOHYA of their decision by an unambiguous statement, by email to administratif@johya.com or by using the model withdrawal form appearing at the end of these T&Cs.

The product must be returned in its original condition, together with all of its accessories (certificate, presentation case, invoice), no later than fourteen (14) days following notification of the withdrawal. The return costs, by insured and signed-for shipment, are borne by the Client.

JOHYA refunds all sums paid by the Client, including the initial delivery costs, within fourteen (14) days from receipt of the returned product or from the Client's proof of dispatch, whichever is the earlier date. The refund is made using the same means of payment as the one used for the order.

In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to goods made to the Client's specifications or clearly personalized (bespoke rings, personalized engravings, etc.). This exclusion is restated on the relevant product page.

Article 11 — Guarantees

The products sold by JOHYA benefit from the legal guarantees provided for by Articles L217-3 et seq. of the French Consumer Code (legal guarantee of conformity) and by Articles 1641 et seq. of the French Civil Code (warranty against latent defects).

The legal guarantee of conformity applies for a period of two (2) years from delivery of the goods. The Client may choose between repair or replacement of the product, subject to the cost conditions provided for by Article L217-12 of the French Consumer Code. The Client is exempt from providing proof of the existence of the lack of conformity during the twenty-four (24) months following delivery of the goods.

The warranty against latent defects allows the Client to obtain restitution of the price or a reduction in the price within a period of two (2) years from discovery of the defect.

These guarantees apply independently of any commercial warranty that may be granted.

Article 12 — Authenticity and certification

JOHYA guarantees the natural authenticity of the stones sold, in accordance with the descriptions appearing on the product page. This guarantee does not exclude the existence of treatments, which are subject to transparent disclosure (see Article 4 and the Authenticity Policy).

Where a gemological certificate is provided, it is issued by an independent laboratory identified on the certificate itself. JOHYA is not the issuer of the certificate and cannot be held liable for an analytical error attributable to the laboratory.

Article 13 — LCB-FT obligations

As a professional trader in precious stones, JOHYA is subject to the obligations relating to the fight against money laundering and terrorist financing provided for by Articles L561-1 et seq. of the French Monetary and Financial Code.

On this basis, JOHYA may be led to:

  • Request a copy of a valid identity document
  • Request proof of address
  • Request supporting evidence of the origin of funds for significant transactions
  • Refuse or suspend a transaction where verification is impossible or where there is suspicion

The thresholds and procedures are determined in accordance with the applicable regulations and with the company's internal LCB-FT procedure.

Article 14 — Liability

JOHYA cannot be held liable for any indirect damage resulting from the order or from the use of the products, nor for damage resulting from an event of force majeure within the meaning of Article 1218 of the French Civil Code.

JOHYA's liability is in any event limited to the amount of the order concerned.

Article 15 — Personal data

The personal data collected in connection with orders is processed in accordance with the Privacy Policy available on the site, in compliance with Regulation (EU) 2016/679 (GDPR) and with Act No. 78-17 of 6 January 1978 as amended.

Article 16 — Mediation and dispute resolution

In the event of a dispute relating to the performance of an order, the Client is invited to contact JOHYA's customer service as a first step at administratif@johya.com in order to seek an amicable solution.

Failing that, the consumer Client, within the meaning of Article L.612-2 of the French Consumer Code, in the absence of an amicable agreement or of a reply from the professional within a reasonable period of one (1) month, has the option of referring the matter free of charge, should a disagreement remain, to the competent mediator entered on the list of mediators drawn up by the Commission for the Evaluation and Control of Consumer Mediation pursuant to Article L.615-1 of the French Consumer Code, namely: Société Médiation Professionnelle, Alteritae, 5 rue Salvaing, 12000 Rodez — www.mediateur-consommation-smp.fr. The Client may also have recourse to the European Online Dispute Resolution platform, accessible at https://ec.europa.eu/consumers/odr/

Article 17 — Governing law and competent jurisdiction

These T&Cs are governed by French law. In the event of a dispute and after any attempt at amicable resolution has failed, the French courts shall have sole jurisdiction, subject to the mandatory rules applicable to consumers.
