General Terms of Use

Article 1 — Purpose

The purpose of these General Terms of Use ("GTU") is to define the terms and conditions of use of the johya.com website, as well as to define the rights and obligations of users (hereinafter "Users").

Access to and use of the site imply full and unreserved acceptance of these GTU.

Article 2 — Access to the site

The johya.com website is accessible free of charge to any User with internet access. All costs relating to access to the site, whether hardware, software or internet access costs, are borne solely by the User.

JOHYA implements reasonable means to ensure continuous access to the site, but cannot guarantee uninterrupted availability. The site may be subject to interruptions for maintenance or for any other cause beyond JOHYA's control.

Article 3 — Customer account

Creating a customer account is optional in order to make a purchase. Where an account is created, the User undertakes to:

  • Provide accurate, complete and up-to-date information
  • Maintain the confidentiality of their login details and password
  • Immediately inform JOHYA of any unauthorised use of their account

JOHYA reserves the right to suspend or delete any account in the event of a breach of these GTU or of fraudulent use.

Article 4 — User conduct

The User undertakes to use the site in compliance with the legislation in force. The following are in particular prohibited:

  • Any attempt to intrude upon or disrupt the operation of the site
  • Automated harvesting of the site's content (scraping, robots)
  • Use of the site for fraudulent or money laundering purposes
  • The publication of unlawful or defamatory content, or content contrary to public order

Article 5 — Intellectual property

All the elements of the johya.com website (texts, photographs, illustrations, logos, the JOHYA trade mark, the structure of the site, the database) are protected by intellectual property law. Any reproduction, representation, modification, publication or adaptation, in whole or in part, without the prior written authorization of JOHYA, is prohibited and constitutes an infringement punishable under Articles L335-2 et seq. of the French Intellectual Property Code.

Article 6 — Hypertext links

The site may contain links to third-party sites. JOHYA exercises no control over those sites and disclaims all liability as to their content.

Article 7 — Amendment of the GTU

JOHYA reserves the right to amend these GTU at any time. The applicable version is the one in force when the User accesses the site.

Article 8 — Governing law

These GTU are governed by French law. Any dispute relating to their interpretation or performance falls within the jurisdiction of the French courts.
